1. Parties
These terms apply between you (the client) and Property Development Advisor / YD Architectural Drafting Services of 27 Military Rd, Avondale Heights VIC 3034, Australia (“we”, “us”).
2. Services
We provide architectural drafting, feasibility, site analysis, town planning support and related packages as described on this website. Scope is limited to the package or written quote you purchase. Deliverables, timelines and inclusions are those stated at the time of purchase unless varied in writing.
3. STCA and no permit guarantee
All advice and design work is subject to council approval (STCA) or the relevant building surveyor. Our advice is not a guarantee that a planning or building permit will be granted. Development applications are subject to statutory process and authority discretion.
4. Fees and payment
Fixed package prices are as displayed (including GST where stated). Level 4 and custom work is quoted separately. Payment for fixed packages is typically required via PayPal or other methods we specify before work proceeds. Regional Victorian site travel may attract additional fees.
5. Client responsibilities
You must provide accurate property and contact information and any documents reasonably requested. You are responsible for obtaining independent legal advice regarding covenants, caveats, title and contracts of sale. Our encumbrance checks are preliminary only.
6. Intellectual property
Copyright in drawings and documents remains with the Building Designer. You are licensed to use the drawings only for the intended subject site. Unless agreed in writing, you receive PDF deliverables only and are not entitled to native CAD files.
7. Skill and care
We will carry out design services using reasonable skill and care consistent with professional practice in Victoria. You are entitled to one set of PDF drawings and documents as a record of the design works as described in the package disclaimers.
8. Website use
Content on this website is general information only and does not constitute formal advice until you engage a package. We may update prices, packages and content without notice. Unauthorised scraping, reverse engineering or misuse of the site is prohibited.
9. Limitation of liability
To the extent permitted by Australian Consumer Law and other applicable law, our liability is limited to re-supply of the services or payment of the cost of re-supply. We are not liable for indirect or consequential loss arising from use of our advice where a permit is refused or conditions are imposed by an authority.
10. Privacy
Personal information is handled in accordance with our Privacy Policy.
11. Governing law
These terms are governed by the laws of Victoria, Australia. Courts of Victoria have non-exclusive jurisdiction.
